Agreement
These Terms of Use (“Terms”) govern your use of POLLY Retro Cam, its website, and related services (“POLLY”). By downloading, purchasing, or using POLLY, you agree to these Terms and our Privacy Policy.
Your use of the iOS or iPadOS app is also subject to Apple’s Standard Licensed Application End User License Agreement (“Apple EULA”). If these Terms conflict with the Apple EULA on a matter Apple controls, the Apple EULA controls.
If you do not agree, do not use POLLY. If you are not old enough to enter a binding agreement where you live, a parent or legal guardian must review and accept these Terms for you.
Your license to use POLLY
Subject to these Terms and the Apple EULA, COCOTOFY LLC grants you a personal, limited, non-exclusive, non-transferable, revocable license to use POLLY on Apple devices you own or control for personal, non-commercial creative use.
You may not copy, resell, rent, sublicense, reverse engineer, circumvent access controls, remove legal notices, or use POLLY to create a competing service except where applicable law expressly permits an activity that cannot be restricted by contract.
Your photos, videos, and creative content
You keep ownership of the photos, videos, audio, captions, notes, Mood Boards, and other content you create or import. POLLY does not claim ownership of your creative content.
You are responsible for having permission to capture, import, edit, share, or publish content and for respecting privacy, publicity, copyright, and other rights. Do not use POLLY to create or share unlawful, abusive, exploitative, infringing, or harmful material.
POLLY primarily processes creative content on your device and through Apple services you control. See our Privacy Policy for details.
Purchases and subscriptions
Apple processes every purchase
Weekly, annual, and lifetime purchases are offered through Apple’s In-App Purchase system. Prices, taxes, currency, payment methods, eligibility, refunds, and transaction processing are controlled by Apple and shown before you confirm a purchase.
Auto-renewable subscriptions
Weekly and annual subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period. Apple may charge your Apple Account within 24 hours before renewal. Manage or cancel in Settings → Apple Account → Subscriptions.
Lifetime access
Lifetime access is a one-time, non-consumable purchase that unlocks the premium features available for the supported lifetime of POLLY. “Lifetime” refers to the supported life of the product, not the lifetime of any individual person, device, or company. It does not guarantee that every future feature, separate product, platform, or third-party service will be included.
Trials, offers, and codes
Introductory offers, promotional offers, and offer codes may have eligibility rules, redemption limits, expiration dates, territories, or other conditions set by Apple. Unless required by law, offers cannot be combined or exchanged for cash.
Refunds
Apple handles refund requests under its policies. Request help at reportaproblem.apple.com.
Changes to features and pricing
We may improve, add, remove, or redesign features. We may change prices for future purchase periods or new customers, subject to Apple’s notice and consent requirements. Changes do not alter a billing period you already purchased except as allowed by Apple’s rules and applicable law.
Acceptable use
You agree not to misuse POLLY, interfere with its operation, attempt unauthorized access, distribute malicious code, abuse purchase or offer systems, violate law, infringe another person’s rights, or use the app in a way that could harm people, services, or devices.
POLLY is a creative camera, not an emergency, safety, archival, medical, or professional recordkeeping service. Keep independent copies of important media.
Third-party services
POLLY relies on services provided by Apple and RevenueCat for app distribution, iCloud features, purchase processing, entitlement verification, and restoration. Their terms and availability also apply. We are not responsible for interruptions or decisions made by services we do not control.
Intellectual property
POLLY’s software, branding, interface, original artwork, text, and other product materials are owned by COCOTOFY LLC or its licensors and are protected by intellectual-property laws. These Terms do not transfer ownership of POLLY or its brand to you.
Disclaimers
To the fullest extent permitted by law, POLLY is provided “as is” and “as available.” We do not guarantee uninterrupted operation, perfect results, permanent storage, compatibility with every device or OS version, or that every defect will be corrected. Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded.
Limitation of liability
To the fullest extent permitted by law, COCOTOFY LLC and its suppliers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost data, media, revenue, or profits arising from POLLY. Our total liability relating to POLLY will not exceed the greater of the amount you paid for POLLY during the 12 months before the claim or the minimum amount required by applicable law.
Suspension and termination
You may stop using POLLY at any time. We may suspend or terminate access where reasonably necessary to protect users or services, comply with law, or address material violations of these Terms. Provisions that by their nature should survive termination will survive.
Changes to these Terms
We may update these Terms to reflect product, legal, or operational changes. Updated Terms will appear here with a new effective date. Where required, we will provide additional notice or request consent.
General
If a provision is unenforceable, the remaining provisions remain effective. A failure to enforce a provision is not a waiver. You may not transfer these Terms without our consent; we may transfer them as part of a reorganization, financing, merger, acquisition, or sale of POLLY, subject to applicable law.
